Three Credible Expert Witnesses To Testify In Upcoming Trial That Johnson's Baby Powder Causes Ovarian Cancer

Expert witness testimony may carry the day and lead to another multi-million dollar jury award against Johnson & Johnson

Monday, September 30, 2019 - Jury selection has begun in another wrongful death case against Johnson & Johnson, this time in Fulton County Georgia with Judge Jane Morrison presiding. 65-year-old Diane Brower died in 2016 from ovarian cancer that her family members claim was caused by using Johnson's Baby Powder. It is alleged, like others before her and thousand still to come, that the lifelong regular and daily use of Johnson's Baby Powder for feminine hygiene caused particles to make their way into her vagina and travel up into her ovaries and become lodged for decades, causing irritation that led to cancer. Brower claims to have used Johnson's Baby Powder twice daily for most of her adult life starting as a teenager and ending with her 2013 ovarian cancer diagnosis. Browers's case was slated to begin earlier in the year but was delayed until now because lawyers for Johnson & Johnson challenged the "credentials, expertise, and scientific methodology of three experts who are expected to testify on behalf of the family," according to PR Newswire.com. A Georgia Federal Court judge ruled that three expert witnesses "Laura Plunkett, PhD, a board-certified pharmacologist, toxicologist and regulatory expert; Dr. John Godleski, a pathology professor in the Department of Environmental Health at the Harvard School of Public Health; and Dr. James Barter, director of Gynecologic Oncology Research at Holy Cross Hospital in Rockville, Maryland," may testify on behalf of the plaintiff. The experts are likely to testify as to the ways that talc, an inert mineral mined from the ground, can in and of itself substantially contribute to cancer of the ovaries.

A judge in the 8-day Daubert hearing is currently deciding if thousands of cases such as Diane Brower's can be consolidated into multi-district-litigation to simplify the discovery process and other repetitive administrative procedures. Johnson's Baby Powder ovarian cancer expert Daniel Clarke-Pearson, a Gynecologic Oncologist and Professor of Obstetrics and Gynecology at the University of North Carolina-Chapel Hill testified before the judge. Clark-Pearson stated that "Genital application of powder increases risk of epithelial ovarian cancer in all women and can cause epithelial ovarian cancer in some women," according to the Penn Record." Clark also told the court "particles of talc enter the vagina and migrate into the ovaries through the Fallopian tubes and incite an inflammatory process that includes oxidative stress and specific genetic mutations."
